Crew Management Manual (CMM) Dismissal & Termination |

1. APPLICATION
This document is applicable to Master.
2. PURPOSE
The purpose of this document is to provide instructions to Master on carrying out a Crew Dismissal process.
3. RESPONSIBILITIES
Master will be responsible for ensuring the dismissal processes are complied with.
4. CREW DISMISSALS
Master can dismiss a crew member if the crew member is involved in any of the following:
- Violation of MARPOL or any other international regulations
- Violation of Company’s Drug and Alcohol Policy
- Violation of Company HSSEQ Policies
- Drunk while on duty
- Illegal activities – Drug trafficking, contraband
- Assaulting fellow crew or anyone onboard at all times whether in port or during shore leave or while traveling to join the vessel
- Unauthorized absence from duty
- Not returning from shore leave
- Gross negligence in work which may affect the safety of the crew or vessel or environment
- Unacceptable performance at work with negative attitude
- Desertion attempt
- Act of disobedience to lawful order of Master or Head of the Department(s)
- Gambling which results in fighting or any incidents
- Pilferage or theft of ships' stores or cargo
- Gross negligence and failure to observe proper storage and cargo handling procedures resulting in delay of vessel or damage to cargo
- Being left behind by vessel in foreign port without justifiable reason
- Inflicting harm or injury to others
- Abuse of authority and resulting in harm to subordinate
- Connivance with or cuddling of stowaway
- Fake certificates and documentation
- Violation of safety regulations
- Incompetence and inefficiency even after giving warnings and time to improve
Master shall conduct a board hearing giving the crew member the opportunity to explain or defend himself against the charges.
Master shall include two other members in the committee, preferably one from the same department and similar rank that of the crew.
Master shall prepare the board hearing report in ADM19.
Master shall make appropriate log book entries for hearings and dismissals.
Master must not dismiss a crew member if he or she is not fully convinced.
Master must ensure that all the evidence and supporting documents to prove the dismissal are available and provided to crewing operations.
Master shall issue ADM 20 for all dismissals with the reason for dismissal.
Master must mention the appropriate CBA clauses for non-Filipino crew and POEA clauses for Filipino crew against reasons for dismissals in ADM-20.
Note:
- Incompetence and inefficiency of a crew member is not easy to prove, hence there should be enough evidences, warning, witnesses before dismissal of any crew under this category. Refer CMM6.15 Seafarer Performance Management- Section 6.15.3 “Under Performers”

- Master must consult with crewing Managerif he/she have any questions on dismissal procedures.
